What gets apostilled vs. what doesn't

The Tennessee SOS apostille authenticates the seal and signature of an official Tennessee government source. Two main categories qualify:

  • Documents notarized by a Tennessee notary public — your power of attorney, single-status affidavit, business documents, school records signed by an official, etc., after a TN notary acknowledges the signature.

Which countries need an apostille vs. authentication

Apostilles are valid for countries that signed the 1961 Hague Apostille Convention — that's most of Europe, all of Latin America, much of Asia (including China since 2023), and many others. For non-Hague countries (a small and shrinking list), you need a chain authentication: TN SOS → U.S. Department of State → destination country's embassy in the U.S.

FAQ

Can you apostille a document I already had notarized in another state?

No — the apostille has to come from the state where the document was notarized. We can only apostille TN-notarized documents (or TN state-issued vital records and certifications).

Does my birth certificate need to be notarized before apostille?

No — a Tennessee birth certificate issued by TN Vital Records is already an official government document. The SOS apostilles the registrar's signature directly. Birth certificates from other states need that state's apostille.

How long does the apostille itself last?

Apostilles do not expire — but the underlying document may. A background check apostilled today is still apostilled forever; whether the destination country accepts a 6-month-old check is up to that country's rules.
